What if an applicant's proceedings extend beyond the 12 month term of the loan? Is the applicant required to repay the Guardian loan before settlement?
The 12 month loan term is designed to meet the needs of an average matrimonial or de facto settlement action. However, depending on the circumstances, Guardian may in its discretion extend the term of the loan for a further period.
If a borrower's financial circumstances alter during the loan term, could the borrower pay off part or all of their loan before the borrower's case settles?
The borrower will have the right to repay all of their loan at any time without penalty but not part of it.
